University and Student Services Terms and Conditions

The services of the University and Student Services Inc, an Illinois corporation usually known as USS is provided subject to your (the “Customer”) compliance and acceptance with the terms and conditions set forth below (this “Agreement”). Please read the following agreement carefully. The Customer’s use of any of USS services indicates the Customer’s agreement to be bound by this Agreement. This Agreement is strictly between USS and the Customer and does not in any way constitute or imply any relationship with any other parties. USS does reserve the right to share access with third-parties for IT support specifically. As a condition to using any of USS services, and for the mutual benefit of both USS and the Customer, the undersigned customer agrees to the following terms and conditions:

Disclaimer
USS’s liability under this Agreement shall be limited to general money damages in an amount not to exceed the charges for the term of service paid by the Customer in the term under which the damages are alleged to have occurred. This liability shall be the extent of USS’s liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the Customer’s exclusive remedy in lieu of any and all other remedies.  In no event will USS be held liable or be responsible for any consequential, special, indirect, incidental, or punitive damages whether or not USS knew or should have known of the likelihood of any loss or damages. USS disclaims all warranties express or implied with respect to the services rendered under this Agreement including merchantability and fitness for a particular purpose.

The customer acknowledges and agrees to assume complete responsibility for any rental equipment and the potential fees listed below until it is returned to USS.

Section 1: Payment
Pricing for services can be found on the USS website. USS accepts all major debit and credit cards as form of payment (ex. Mastercard, visa, amex, discover, etc). Applicable service fees will be debited from the credit card on file. Authorization to debit applicable service fees from credit card on file is agreed to upon agreeing to our terms and conditions at checkout. Accepting the terms and conditions at checkout indicates to USS that you consent for any *applicable* fees for any service not specifically covered by the insurance to be charged to the card on file automatically.

AUTO-CHARGE AUTHORIZATION:

By accepting USS terms and utilizing USS Services, the Customer agrees to authorize University and Student Services to automatically charge the Customer’s provided credit card for all charges related to the Services, including but not limited to additional fees, and any other applicable charges. This auto-charge authorization shall remain in effect for the duration of the Customer’s use of Storage services. The Customer acknowledges that their credit card will be automatically charged on the due date for all outstanding amounts owed to University and Student Services, for any service and applicable fees. In the event of a failed auto-charge attempt due to expired or invalid credit card information, USS’s inability to receive credit card authorizations, or any other reason that prevents USS from receiving payment for the Services, the Customer agrees to promptly update their payment information and ensure that USS is paid for the services and any additional fees. The Customer understands and agrees that they are responsible for any charges incurred on their account because of the auto-charge authorization, and they will not hold USS liable for any overdraft fees or other charges imposed by their credit card issuer or bank due to insufficient funds or any other reasons. If the Customer wishes to revoke the auto-charge authorization, they must provide written notice to USS at least 30 days prior to their next scheduled billing date. Revoking the auto-charge authorization may result in the termination of the Services and may subject the Customer to additional fees and penalties as outlined in these Terms and Conditions. By continuing to use USS services and accepting these Terms, the Customer acknowledges and agrees to the auto-charge authorization clause, as set forth above, and authorizes University and Student Services to automatically charge their provided credit card for all applicable fees and charges.

Section 2: Applicable Fees (all Services)

  • Damaged or Missing MicroFridge® Unit: $495.00
  • Damaged or Missing Minifridge Unit: $335.00
  • MicroFridge®/MiniFridge Cleaning Fee: $50.00
  • Dissembling MicroFridge® Unit: $50.00
  • Missing MicroFridge® turn table plate: $25.00
  • Damaged or Missing Water Cooler
    • Arizona State – $150.00
    • University of Arizona – $150.00
    • Tulane University – $300.00
  • Refurbishing fee (Tulane University Only): $50.00
  • Jug Overage fee (Tulane University Only): $15.00 per jug
  • Missing Empty Jugs (Jugs not properly returned): $7.00 per jug
  • Unit pick-up fee (Any Rental Equipment): $40.00
  • Auto renewal charge for Spring Semester (Excluding MicroFridge®/MiniFridge Rentals)
  • Cancelation Fee: $0.00-$40.00 (dependent on time of cancelation request, see refund policy)
  • Failure to notify of room change (Any Rental Equipment): $25.00

Section 3: Refund Policy (all Services)

  • MicroFridge®’s are refundable when a student cancels before the unit is delivered.
  • After the unit is delivered, a partial refund is given ($40.00 pick-up fee deduction) if canceled within 2 weeks of the student moving in.
  • MicroFridge®’s are nonrefundable when a student has had the unit in their possession for 2 weeks or longer.
  • Minifridges are always refundable upon cancellation.
    • After the unit is delivered, a $40.00 pick-up fee will be deducted from the refund.
    • (Northwestern University only)

  • Cooler + Water Jug Delivery Plans:
    • All Water Cooler + Jug Delivery plans are entitled to a full refund prior to the install.
    • If we are contacted after the equipment has been installed, there is a $40.00 pick-up fee deducted from your refund.
    • Equipment returned after install at Tulane University will have a $40.00 refurbishing fee deducted from their refund.
    • Unused jugs that have already been delivered are not refundable.
  • Water Jug Only Delivery Plans:
      • Refunds are solely dependent on the time of cancelation. Once cancelation is requested, our customer care team will notify you of the refund amount.
      • Unused jugs that have already been delivered are not refundable.
  • Laundry is 100% refundable when it is canceled prior to service start date.
  • If cleanings have passed, the refund you receive is pro-rated and based on the time of cancelation.
  • Laundry refunds are not issued and rescheduling is not available for any forfeited cleanings.

Section 4: Insurance

  •  Fridge Additional Insurance
    • This insurance covers all damages, broken parts, and missing items upon pick-up except a missing microwave plate.
    • This coverage does not cover a dirty unit.
  • Fridge Cleaning Service
    • Opt-in to avoid a possible $50.00 cleaning fee! Just unplug your MicroFridge® or Minifridge, take all of your personal items out and we will clean it upon pick-up at the end of your rental term!

  • Water Additional Insurance
    • insurance covers any damages to the cooler while in your students possession. It also covers any theft of up to (2) jugs. While theft is not a common issue we face, it does cover the replacement jugs should this occur. 
    • Students are responsible for reporting stolen jugs to their RA or front desk before USS is able to submit a request for replacement
    • DOES NOT COVER fee for loss or theft of the unit
    • DOES NOT COVER fee for moving the unit and not notifying USS
    • DOES NOT COVER any other fee not explicitly stated as being covered

The insurance is optional and the customer is responsible for any fees not specifically covered by the insurance.

Accepting the terms and conditions at checkout indicates to USS that you consent for any *applicable* fees not specifically covered by the insurance to be charged to the card on file automatically. 

We will contact you personally if there are any problems with the card on file.


Section 5: Garment Service (Laundry Service Only)

USS accepts no liability for damage due to normal cleaning of items without care instructions and accepts no liability for items treated in accordance with the care labels or other instructions provided. USS accepts no liability for “special care” items that require special attention to be cleaned or that do not have care instructions. USS is not responsible for clothing bleeding, shrinking, or otherwise changing as a result of normal washing procedures. Precautions will be taken to alleviate these problems if possible. USS reserves the right to refuse to clean any garment. USS does not guarantee the removal of all stains. USS will have its cleaning service re-clean items that, at its sole discretion, were not properly cleaned and have not been worn since they were cleaned. USS is not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or laundry bags such as money, jewelry, or any other item. The customer agrees not to leave such items in its clothing or in its laundry bags.

  • Missing or damaged items must be reported to us within three (3) days
  • In the rare instance that your garment is lost or damaged by USS, we will issue you a refund or credit for the value of that garment, as specified in the National Fair Claims Guide from the International Fabricare Institute (“IFI”), after seven (7) days of being reported missing/damaged.
    • If the customer is unable to document the age of a garment, the customer can attest to the age but USS, in its sole discretion, may limit the minimum age of any garment to one year. If no current replacement cost is available (e.g., because the item is no longer available in stores), USS may use the replacement cost of a comparable item currently available.
    • Maximum reimbursement for each individual item is $200

Section 6: Waiver
Except as specifically provided in this Agreement, the Customer waives any claims for damage to, or loss of, any article against USS and its representatives. The Customer expressly releases and holds USS, and its representatives, agents, and employees harmless from any and all costs of processing any claim or defending any claim arising from this Agreement.

Section 7: Choice of Law
This Agreement shall be governed, interpreted, and construed according to the laws of the State of Illinois without regard to its conflicts of laws provisions. The customer agrees that all disputes shall be resolved by bench trial.  The customer does hereby waive any and all rights to a jury trial in the event of a dispute between Customer and USS.  The Customer agrees that any court action pertaining to this Agreement shall be conducted in and that venue specifically lies in the court of the Eighteenth Circuit District, DuPage County, Illinois.

Section 8: Affiliates

All current or past USS customers are eligible to become a USS Affiliate by completing the registration form at https://uandss.com/affiliates/. Affiliates are able to earn $10 on each sale referred via their assigned affiliate link, available in their affiliate portal. Payouts will occur quarterly according to the affiliate referral data tracked on the USS website and found in the USS Affiliate portal. 

The Customer sets the pick-up date and time. USS reserves the right to reschedule such times without prior notice to the Customer.

For storage services, USS will make available packaging materials approximately one week prior to the commencement of the university move-out week. USS will notify the Customer in advance of the dates, times, and locations where the USS materials can be obtained. It is the responsibility of the Customer to make arrangements to pick up the packaging materials during the times specified.

USS will not pick up any items that are not properly packed in USS boxes or other appropriate shipping materials and that are not appropriately labeled. The Customer is responsible for all damage to belongings inside the USS packaging materials or anything else when caused by any items present in the packing materials. It is the Customer’s responsibility to pack his/her boxes or shipping boxes by his/her scheduled pick-up time. The storage registration is non-refundable and does not apply to the per-item storage cost/fee.

In the case of shipping storage items home, USS cannot open or separate packaged items. Items must either be shipped all together or donated.

Section 1: Applicable Fees

  • Overweight Fee (Any box, tote, suitcase, duffel bag, or trunk): $100.00 per item
  • Appointment rerouting (applies if the truck has to wait or come back): $40.00
  • Appointment rescheduling/cancelation  (3 business days prior to scheduled date): $40.00
  • Appointment rescheduling/cancelation (less than 2 business day prior to scheduled date): $75.00 – $200.00
  • Additional Mileage Fee (between 2-5 miles): $200.00 – $300.00
    • Northeastern in Boston, MA is not eligible for a delivery outside of 1 mile.
    • Arizona State University encompasses four distinct campuses—Tempe, West Valley, Polytechnic, and Downtown. For students residing on any of these campuses or in their vicinity, USS is pleased to offer free delivery services within a 2-mile radius. 
  • Non-standard delivery dates: $200.00
    • Northeastern in Boston, MA is not eligible for an early delivery that occurs prior to our scheduled time to be on campus
    • Drexel in Philadelphia, PA is not eligible for an early delivery that occurs prior to our scheduled time to be on campus
  • Non-Standard delivery date + Additional mileage: $400.00 – $500.00
  • Request of Return (within 24hrs): $240.00
    • A $240.00 fee may be incurred if items are requested to be returned within 24 hours of pick-up due to non-payment or refusal to pay storage fees, depending on crew availability.

Section 2: Insurance

USS offers a basic insurance policy that provides coverage for loss or damages up to $100.00 per order. USS also offers customers the choice to enhance their insurance coverage with three additional options priced at $19.99, $39.99, or $59.99. These options increase the coverage value to $1,000, $2,000, or $3,000 per order, respectively. USS highly advises customers to consider purchasing additional insurance if the value of their belongings exceeds $100.00 for the order. If no additional insurance is purchased by the Customer, the Customer agrees that the released value of the entire order is no greater than $100.00 and that USS’s liability is limited to $100.00 per order. The insurance policy does not provide coverage for certain items, including taxes and shipping costs related to the purchase of any item, jewelry, collectibles, cash, items of intangible value, metal or plastic shelving that has not been disassembled, extremely fragile items such as mirrors, improperly packed items (such as TVs and mattress pads that have not been properly packed or covered, and/or loose items not securely packed within a box) , unboxed TVs, unboxed monitors, and any damage caused by liquid or force majeure. Additionally, any box, tote, trunk, duffel bag, or suitcase that exceed the 50lb weight limit are not eligible for coverage or reimbursement from USS. Any item not clearly listed on your USS Storage pick-up ticket will not be eligible for reimbursement. *It is the student’s responsibility to carefully review their pick-up ticket promptly and report any discrepancies to our office.

USS provides only coverage which is secondary to Customer’s primary coverage which is his or her homeowner’s or renter’s insurance (or that of his or her parents).  USS makes no representation concerning the adequacy of its insurance coverage or coordination of its insurance coverage with that of Customer. Coordination of insurance coverage is solely the responsibility of Customer.  The Customer agrees to first claim any loss against any insurance carried by the Customer or the Customer’s parents, if available. The Customer will make claims against USS only after exhausting other areas of coverage.

To the extent that the Customer does not obtain insurance coverage for the full value of his personal property stored or shipped with USS, the Customer hereby agrees to assume all risk of loss, including damage or loss by burglary, fire, rust, water, changes in temperature, fumigation, vermin or other insects, or vandalism. USS and its employees, authorized representatives, agents, and affiliates will not be responsible for, and the Customer hereby releases from, any loss, liability, claim, expense, damage to property or injury to persons that could have been insured (including without limitation any loss arising from the active or passive acts, omission or negligence of USS or its agents, affiliates, authorized representatives and employees).

In the event of damage, it is essential to provide evidence of physical damage to the exterior of the box or packaging. Please note that USS cannot be held responsible for any concealed damage to items within a crate, trunk, or other casing if there is no physical damage to the exterior of the package. It is important to understand that damage solely to the exterior of the box, trunk, or casing does not automatically imply liability on the part of USS.

Customers are kindly requested to report any missing or damaged items to USS within two (2) days of the delivery or move-in. If you are submitting a claim for damaged items, please ensure to include photos showing the damage. Failure to provide photos may result in the denial of your claim. For a claim valued at $300.00 or more, proof of purchase will be required. Not providing proof of purchase may lead to the potential denial of your claim.

Section 3: Ownership of Property
The Customer has represented and warranted to USS that he/she is the legal owner or in lawful possession of the property and has the legal right and authority to contract for services of all of the property tendered to USS.

Section 4: Storage Payment

Storage fees are charged to the card on file immediately after the items are picked up. If storage is extended for additional sessions, payment will be charged to the card on file at the beginning of each new session. Our storage sessions are organized by semester, which include Summer (May-Aug), Fall (Aug-December), and Spring (Jan-April). Delivery and/or pick up fees may be applicable if a delivery or pick up is requested during the session and/or outside of the designated mass student deliveries/pick ups, if available.

By accepting USS terms and utilizing USS Storage services, the Customer agrees to authorize University and Student Services to automatically charge the Customer’s provided credit card for all charges related to the Services, including but not limited to storage fees, shipping fees, additional fees, and any other applicable charges. This auto-charge authorization shall remain in effect for the duration of the Customer’s use of Storage services. The Customer acknowledges that their credit card will be automatically charged on the due date for all outstanding amounts owed to University and Student Services, for any storage and applicable fees. In the event of a failed auto-charge attempt due to expired or invalid credit card information, USS’s inability to receive credit card authorizations, or any other reason that prevents USS from receiving payment for the Services, the Customer agrees to promptly update their payment information and ensure that USS is paid for the services and any additional fees. Failure to do so may result in a delay in the delivery of the Customer’s possessions, additional fees, or the transfer of ownership to USS as stated in Section 6: Failure to Pay Storage Fees. The Customer understands and agrees that they are responsible for any charges incurred on their account because of the auto-charge authorization, and they will not hold USS liable for any overdraft fees or other charges imposed by their credit card issuer or bank due to insufficient funds or any other reasons. If the Customer wishes to revoke the auto-charge authorization, they must provide written notice to USS at least 30 days prior to their next scheduled billing date. Revoking the auto-charge authorization may result in the termination of the Services and may subject the Customer to additional fees and penalties as outlined in these Terms and Conditions. By continuing to use USS services and accepting these Terms, the Customer acknowledges and agrees to the auto-charge authorization clause, as set forth above, and authorizes University and Student Services to automatically charge their provided credit card for all applicable fees and charges.

Section 5: Extended Storage Payment

Customer acknowledges that USS will charge additional storage fees for extending storage. Customer accepts USS’s policy of storing items for four months at a time and each account/card will be auto-charged at the beginning of each new semester.

Section 6: Failure to Pay Storage Fees

USS reserves the right to delay the delivery of the customer’s possessions until payment for the service and any additional incurred fees has been paid in full. If payment is not received within 30 days of the pick up and/or the start of a new session, USS reserves the right to assume ownership over the property. Once USS has taken ownership, USS reserves the right to donate the items.

    • A $240.00 fee may be incurred if items are requested to be returned within 24 hours of pick-up due to non-payment or refusal to pay storage fees, depending on crew availability

Section 7: Abandonment
The Customer agrees that his failure to be present on the scheduled delivery date and time his failure to communicate with USS concerning an alternate delivery arrangement constitutes abandonment of his stored possessions.

Customer agrees to pay USS for all charges and fees relating to the failed delivery and/or further storage and shipping costs related to abandonment of customer property. USS has the right to assume ownership of the abandoned property after 30 days of the originally scheduled delivery date.

These terms and conditions DO NOT apply to the following move-ins:

  1. Assisted Plus Move-in
  2. Express Move-in
  3. Traffic Management

These terms and conditions DO APPLY to the following move-ins:

  1. Cruise Ship Move-in

Section 1: Insurance and Claims

In the even that any item(s) are missing during a move-in, USS will open a claims process for any items reported as damaged or lost. Please note that any claims made after the 48 hour time frame of the student moving in will not be accepted. Additionally, USS offers secondary coverage to supplement your primary homeowner’s or renter’s insurance (or that of your parents). Please be aware that USS’s liability is limited to $1,000.00 per student if reported within the 48-hour move-in deadline. USS does not reimburse for taxes or shipping costs associated with any item.

If you are submitting a claim for damaged items, please ensure to include photos showing the damage. Failure to provide photos may result in the denial of your claim. For a claim valued at $300.00 or more, proof of purchase will be required. Not providing proof of purchase may lead to the potential denial of your claim.

If any items are damaged, we require visible physical damage to the exterior of the box or packaging. USS cannot be held responsible for hidden damages within crates, trunks, or other casings unless there is evident damage to the exterior of the package. Please note that damage to the box, trunk, or casing does not automatically imply liability on the part of USS.

USS does NOT cover the following if reported in a claim: jewelry, collectibles, cash, or items of intangible value.

USS makes no representation concerning the adequacy of its insurance coverage or coordination of its insurance coverage with that of the Customer.  Coordination of insurance coverage is solely the responsibility of the Customer.  The Customer agrees to first claim any loss against any insurance carried by the Customer or the Customer’s parents, if available. The Customer will make claims against USS only after exhausting other areas of coverage.

To the extent that the Customer does not obtain insurance coverage for the full value of his personal property stored or shipped with USS, the Customer hereby agrees to assume all risk of loss, including damage or loss by burglary, fire, rust, water, changes in temperature, fumigation, vermin or other insects, or vandalism. USS and its employees, authorized representatives, agents, and affiliates will not be responsible for, and the Customer hereby releases from, any loss, liability, claim, expense, damage to property, or injury to persons that could have been insured (including without limitation any loss arising from the active or passive acts, omission or negligence of USS or its agents, affiliates, authorized representatives and employees).
